Divorce, it is undoubtably the end of a chapter, the end of the future you foresaw and the plans you had made. It is the end to everything you foresaw when saying ‘I do’. Regardless of who ended the relationship, divorce is hard on both parties involved.

It is important to understand that Divorce is the legal termination of a marriage.

In Australia, we work on a no-fault divorce system, meaning the court does not consider why the marriage ended or who ended it. It is difficult for some parties to accept this because divorce can be accompanied with bitterness, heartache and broken promises.

A divorce can be obtained by either party if you can demonstrate that separation has been for at least a minimum 12 months.

You will need to be an Australian citizen by birth, descent, grant of citizenship or regard Australia as your home and intend to live in Australia indefinitely or live in Australia and have done so for 12 months immediately prior to applying for divorce.

The court will also consider, the length of the marriage, and the children of the marriage under the age of 18 and there care arrangements.
