Superannuation Splitting Orders



Superannuation Splitting Orders are essentially Orders made by the Federal Circuit and Family Court of Australia for one person’s superannuation entitlement to be split and a portion deposited into the other person’s superannuation fund.

When agreeing to split a party’s super it is important to understand that this does not convert superannuation into a cash asset. It will transfer your superannuation or your spouse’s superannuation from one fund to the other. The superannuation laws still apply to Superannuation Splitting Orders.

When applying for a Superannuation Splitting Order you are required to obtain procedural fairness from the relevant superannuation fund.
